Ask Your Doctor — Terms of Service

By using AskYourDoctor, you agree to both Apple’s Standard End User License Agreement (EULA) and these Supplemental Terms of Service. The Apple Standard EULA can be found here: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

1. Purpose of the App & AI

AskYourDoctor is an AI‑powered tool designed to help you organise your health data and generate questions for your healthcare provider. It is not a substitute for professional medical advice, diagnosis or treatment. Always consult a qualified healthcare provider for any health concerns.

2. User Responsibilities

You are responsible for the accuracy of the data you input or share with the app. Do not misuse the app or use it for any unlawful or prohibited purpose.

3. Data Privacy & Security

Your privacy and data security are paramount. Health data you enter, import or upload is processed on‑device where feasible and encrypted in transit when sent to our AI processor. We do not access, receive or store your clinical health records or uploaded content. The app communicates directly and securely with OpenAI’s Business API (no SimQuant proxy servers).

When AI features are enabled, your inputs — which may include personally identifiable health information (PHI) — are sent to OpenAI solely to generate the requested response. This content is not used to train OpenAI models by default. By default, OpenAI may retain limited abuse‑monitoring logs for up to 30 days. 4. Disclaimers & AI Limitations

While the AI aims to provide relevant insights, it is a generative model and may, in rare instances, produce inaccurate or incomplete information. You should independently verify any information and not rely solely on the app’s output for critical health decisions. The app is provided “as is” without warranties of any kind.

5. Third‑Party Services (OpenAI)

AskYourDoctor integrates with OpenAI’s Business API. Content you submit — which may include PHI — is transmitted solely to generate your AI response, not to train models by default. By default, OpenAI may retain certain abuse‑monitoring logs up to 30 days. 6. AI Features & PHI Authorization

By enabling and using AI features, you authorise disclosure of your inputs — which may include PHI — to OpenAI as our processor solely to generate AI responses within the app. If you no longer agree, stop using AI features and remove the app. You may continue to use non‑AI features without sharing your clinical data.

7. No Medical Advice & Emergencies

Outputs are for informational purposes only. Always seek the advice of a qualified healthcare provider with any questions or concerns about a medical condition. Do not use the app for emergencies; call your local emergency number.

8. Governing Law & Dispute Resolution

These Supplemental Terms are governed by California law and disputes arising from these Terms will be resolved through binding arbitration in California.

9. Termination

We may suspend or terminate your access to AskYourDoctor immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Supplemental Terms or the Apple EULA. All provisions which by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity and limitations of liability.
